Bikers in the Chattahoochee Valley cross between Alabama and Georgia without a second thought, sometimes several times a day. The bridges are short. The legal distance between the two states, when it comes to shared fault in a crash, is surprisingly wide.<\/p>\n

\nThe Alabama Side<\/strong><\/p>\n

Alabama follows contributory negligence, one of the strictest standards in the country. If a rider is found even slightly at fault, recovery from the other driver can generally be barred.<\/p>\n<\/div>\n

\nThe Georgia Side<\/strong><\/p>\n

Georgia uses modified comparative fault. A rider can still recover as long as they’re less than 50 percent responsible, with the recovery reduced by their share of fault.<\/p>\n<\/div>\n<\/div>\n

The Same Percentage, Two Outcomes<\/h2>\n

Consider how the rules treat a rider found 10 percent at fault. In Georgia, that rider’s recovery is reduced by 10 percent. In Alabama, that same 10 percent can generally prevent recovery from the other driver altogether. Only the location changed.<\/p>\n

Why Motorcyclists Feel This More<\/h2>\n

Fault in motorcycle crashes is often disputed. Drivers turning left may say they never saw the bike, and speed or lane position becomes part of the argument. On the Alabama side of the river especially, even a small share of blame carries big weight.<\/p>\n
